These Terms of Service ("Terms") are an agreement between eOTP, LLC ("Colony," "we," "us," or "our") and the business entering into them ("Customer," "you"). By creating a Colony account or using the Colony platform at colonys.io, you agree to these Terms on behalf of that business. If you don't have authority to bind the business, don't create an account.
Colony is a business-to-business (B2B) service. It is intended for use by businesses and their authorized personnel, not by individual consumers for personal use. You must be at least 18 years old and authorized to act on behalf of the business you're registering.
Colony is a customer relationship management (CRM) platform providing lead, customer, ticket, task, and sales management, along with optional integrations for messaging (WhatsApp, SMS, voice) and AI-assisted content generation. We may add, change, or remove features over time.
Colony is currently provided free of charge. We may introduce paid plans in the future, with advance notice before any charge applies to your account.
Some features connect to third-party services (for example, WhatsApp/Meta messaging, SMS/voice via LogicSMS, or other integrations such as Pipedrive) that bill you directly for their own usage, independent of Colony. Any such fees are between you and that third party under their own pricing and terms — Colony is not responsible for third-party charges.
Colony connects to third-party platforms, including but not limited to the Meta/WhatsApp Business Platform and LogicSMS (SMS and voice). Your use of these integrations is also governed by that provider's own terms:
We may suspend a specific integration for your account if we reasonably believe your use of it violates the relevant third party's policies or applicable law.
As between you and Colony, you retain ownership of the business data you input into the platform (your leads, customers, tickets, and related records). We process it to provide the service to you, as described in our Privacy Policy. We do not sell your data, and we do not use it to train AI models.
You agree not to use Colony to:
Some features send content to third-party AI providers to generate output on your behalf (see our Privacy Policy Section 4). AI-generated content may be inaccurate or require review — you're responsible for reviewing content before relying on or publishing it (for example, AI-generated pages).
Colony and its underlying software, design, and branding are owned by eOTP, LLC. These Terms don't grant you any rights to our intellectual property beyond the right to use the service as intended. You retain all rights to your own business data and content.
You may stop using Colony and request account deletion at any time by contacting us. We may suspend or terminate your access if you materially breach these Terms, including violating Section 8 (Acceptable Use) or a connected third party's policies (Section 6) in a way that puts our platform or other customers at risk.
Colony is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the service will be uninterrupted, error-free, or that AI-generated content will be accurate.
To the maximum extent permitted by law, eOTP, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of Colony. Our total liability for any claim relating to the service is limited to the amount you paid us (if any) in the 12 months before the claim arose.
You agree to indemnify and hold eOTP, LLC harmless from claims arising out of your misuse of the service, your violation of these Terms, or your violation of any third party's rights (including recipients of messages you send through Colony's integrations).
These Terms are governed by the laws of the United States and the state in which eOTP, LLC is organized, without regard to conflict-of-law principles. [State/jurisdiction to be confirmed once finalized with counsel.]
We may update these Terms from time to time. We'll update the "Last Updated" date above, and for material changes we'll make reasonable efforts to notify active account holders before they take effect.

Known open items before publication: (1) eOTP, LLC is a placeholder entity pending registration of Colony's own LLC — update the entity name and governing-law state here once that's final; (2) fee/refund terms should be revisited once a real pricing model is decided; (3) this page should be linked from Sign Up (with an explicit "I agree" checkbox) and the site footer once approved.
